Victim Impact Statement

If you have been harmed by a crime, you may tell the court what harm or loss you have suffered by completing a Victim Impact Statement and a Statement of Restitution . These forms help the court understand how you were affected by the crime. 

Any person can prepare a victim impact statement who has suffered physically or emotionally, or who has had their property damaged or lost money, as a result of an offence committed against them or another person. A victim impact statement can also be prepared by:

  • the survivors of deceased victims;
  • the parent or guardian of a child victim; or
  • a spouse, common-law partner, dependent or relative of a victim who is not capable of making a statement.

HOW TO PARTICPATE

Please let us know if you wish to complete a Victim Impact Statement by submitting this online form within 10 days of the incident

To complete a Victim Impact Statement:

  1. Download  the Ontario Government Form 34.2 Victim Impact Statement.
  2. Complete the Government Form. 
  3. Submit the completed Government Form to Kingston Police by:
    1. Emailing to email link with the subject line Victim Impact Statement, or
    2. put the completed Government Form in an envelope, attention Court Services, and drop it off at Kingston Police Headquarters.

DID YOU SUFFER A FINACIAL LOSS?

If you are a victim and have suffered a financial loss, please prepare a statement restitution form.

To complete a Statement of Restitution:

  1. Download  the Ontario Government Form 34.1 Statement of Restitution.
  2. Complete the Government Form. 
  3. Submit the completed Government Form to Kingston Police by:
    1. Emailing to email link with the subject line Statement of Restitution, or
    2. put the completed Government Form in an envelope, attention Court Services, and drop it off at Kingston Police Headquarters.

NOTE: In addition to the Statement of Restitution form, the victim must provide a statement of damages and receipts, if possible.

What is a Victim Impact Statement?

Unfortunately, you have been impacted by crime. As a victim of an offence, you have a right to write a statement that describes the physical or emotional harm, property damage or economic loss which you have suffered as a result. The Court must consider the statement when sentencing the offender.

The victim has a voice in the criminal justice system when an impact statement is written. It allows victims to take part in the sentencing of the offender by explaining to the Court and the offender, in their own words, how the crime has affected them.

Presenting a victim impact statement

If the victim decides to write a victim impact statement, the statement can either be filed with the Judge to read or the victim can present the statement at the sentencing hearing by:

  • reading it aloud in the courtroom;
  • reading it aloud in the courtroom with a support person nearby;
  • reading it outside the courtroom or behind a screen or other device so that the victim cannot see the offender; or
  • presenting it in any other way the Court thinks is suitable.
